Product Liability.

Consumers are frequently injured by dangerous or defective products.

Manufacturing defects are those that occur in the manufacturing process and usually involve poor-quality materials or shoddy workmanship.

Design defects occur where the product design is inherently dangerous or useless (and hence defective) no matter how carefully manufactured; this may be demonstrated either by showing that the product fails to satisfy ordinary consumer expectations as to what constitutes a safe product, or that the risks of the product outweigh its benefits.

Failure-to-warn defects arise in products that carry inherent non-obvious dangers. These can be minimized through adequate warnings to the user, and these dangers are present regardless of how well the product is manufactured and designed for its intended purpose. This also includes failure to provide relevant product instructions or sufficient product warnings.

Anyone who makes products available to the public including manufacturers, distributors, suppliers, and retailers can be held responsible for the injuries those products cause through a lawsuit alleging  negligence, strict liability, breach of warranty, or various consumer protection claims.

Slip and Fall

A slip and fall injury is type of personal injury claim based on a person slipping (or tripping) on the premises of another and, as a result, suffering an injury. A person who is injured by falling may be entitled to compensation for the injury from the owner or person in possession of the premises where the injury occurred.

Liability for slip or trip and fall injuries may arise based upon a defendant's ownership of the premises where the injury occurred, their control of the premises, or both. For example, a store may be liable for a slip-and-fall injury that occurs inside of its premises, even though it rents those premises, because it has exclusive control of the interior of the rented property. The owner of the premises (the store's landlord) may have sole or shared liability for an injury that occurs outside of the store's exclusive premises, such as the injury from a fall on the sidewalk or in the parking lot of a shopping mall.
